I believe that legal writing is unnecessarily complicated, and that clients suffer as a result. When I read a brief that has lots of legalese, it immediately leads me to believe that they have no case. If the facts and the law are on your side, they are still on your side in plain English. If the facts and the law are not on your side, unnecessary legalese makes that easy to hide. I know that judges feel the same way.
With that in mind, I write everything with simplicity and understandability as my objectives. Even the most complex legal arguments can be written in plain English and the client is going to fare better when the court understands the argument.
